Hi there
It's pretty standard to ask permission of the photographer for use of a photograph as a background. In the future do inquire with people before going ahead and using their photos. This time is okay, but usually I do not allow my photos to be used in graphics. If you'd ever like to use one as a reference for drawing, that would be fine.

I'm so sorry! You're right, I should have asked first, and I usually do, too! I don't know what I was thinking...I usually get a "go ahead", so I guess I just...went ahead! It's just such a beautiful gold and looked perfect for her...again, I'm awfully sorry (and pretty embarrassed now!)
